Terms of Service

Effective Date: January 1, 2025

Welcome to Maintenance Made Simple. These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "your," "Customer," or "Client") and Maintenance Made Simple ("Company," "we," "us," or "our"), governing your use of our website at https://maintenancemadesimple.com, our maintenance and handyman services, and all related communications including SMS/text messages, emails, and phone calls.

Please read these Terms carefully before using our website or engaging our services. By accessing our website, submitting a service request, scheduling an appointment, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our website or services.

1. Agreement to Terms

By accessing or using any part of our website, submitting a contact form, requesting an estimate, scheduling a service, communicating with us by phone, email, or text message, or engaging us to perform any maintenance or repair services, you agree to be bound by these Terms of Service, our Privacy Policy (available at https://maintenancemadesimple.com/privacy-policy), and any additional terms and conditions that may apply to specific services or promotions.

We reserve the right to update, modify, or replace any part of these Terms at our sole discretion. Changes will be effective immediately upon posting to our website. Your continued use of our website or services after any changes to these Terms constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for any updates or changes.

You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this Agreement. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Services Description

Maintenance Made Simple provides professional home and commercial property maintenance, repair, and handyman services throughout Palm Beach, Broward, and Miami-Dade counties in South Florida. Our services include, but are not limited to, general handyman work, plumbing repairs, electrical work, painting, drywall repair, carpentry, fixture installation, pressure washing, property maintenance, and other related services as described on our website.

The specific scope of any service engagement will be determined based on an assessment of the work to be performed, which may include an on-site inspection. We reserve the right to refuse any service request at our sole discretion, including but not limited to situations where the requested work falls outside our areas of expertise, presents safety concerns, or conflicts with applicable building codes or regulations.

All services are subject to availability, scheduling, and the terms of any specific estimate or service agreement provided. We strive to perform all services in a professional and workmanlike manner, in accordance with applicable industry standards and local building codes.

3. Service Requests and Estimates

Requesting Services

You may request services by submitting a contact form on our website, calling us at (954) 826-0578, emailing us at info@maintenancemadesimple.net, or texting our business phone number. When submitting a service request, you agree to provide accurate and complete information about the work needed, the service location, and your contact information.

Estimates and Pricing

We offer free estimates for most services. Estimates may be provided over the phone, via email or text message, or after an on-site inspection, depending on the nature and complexity of the work. All estimates are non-binding and are based on our assessment of the work required at the time the estimate is provided. The actual cost of services may vary from the estimate if:

  • The scope of work changes or additional work is discovered during the course of the project
  • Hidden conditions are found that were not apparent during the initial assessment (such as concealed water damage, structural issues, or outdated wiring)
  • You request additional services or changes to the original scope of work
  • Material costs change between the time of the estimate and the performance of the work
  • Access to the work area is more difficult than initially assessed

If significant changes to the estimated cost are expected, we will communicate with you before proceeding and obtain your approval for the revised scope and cost. We will not perform work substantially exceeding the original estimate without your prior consent.

Scheduling and Access

You agree to provide us with reasonable access to the service location at the scheduled time. If you need to reschedule or cancel an appointment, we request that you provide at least 24 hours' advance notice. We reserve the right to charge a cancellation fee or trip charge for appointments cancelled with less than 24 hours' notice or where we arrive at the service location and are unable to gain access.

4. SMS/Text Message Terms

By providing your mobile phone number to Maintenance Made Simple and consenting to receive text messages, you agree to the following terms regarding our SMS/text messaging program.

Consent to Receive Text Messages

By opting in to our text messaging program, you expressly consent to receive recurring automated and non-automated text messages from Maintenance Made Simple at the mobile phone number you provided. Text messages may include, but are not limited to:

  • Appointment confirmations and reminders
  • Service updates and completion notifications
  • Estimate follow-ups and communications regarding your service requests
  • Promotional offers, discounts, and seasonal maintenance tips
  • Billing and payment reminders
  • Satisfaction surveys and feedback requests
  • Other information related to our services and your account

Your consent to receive text messages is not a condition of purchasing any goods or services from Maintenance Made Simple. You may opt in to receive text messages by submitting your mobile number through our website contact form, by texting a keyword to our business number, or by verbally providing your consent over the phone.

Message Frequency

Message frequency varies depending on your interactions with our business and the services you have requested. You may receive multiple text messages per week during active service engagements, and less frequently during periods of inactivity. We estimate that you may receive up to approximately 10 messages per month, though actual frequency will vary based on your level of engagement with our services.

Standard Message and Data Rates

Standard message and data rates may apply to all text messages sent to or received from Maintenance Made Simple, as determined by your wireless carrier and your individual mobile phone plan. You are solely responsible for any messaging or data charges imposed by your wireless carrier. Please consult your wireless carrier's pricing plan for details on applicable rates and charges.

How to Opt Out (Reply STOP to Cancel)

You may opt out of receiving text messages from Maintenance Made Simple at any time by replying STOP to any text message you receive from us. You may also text the word STOP to our business phone number at any time. After you send the STOP message, you will receive a one-time confirmation message verifying that you have been unsubscribed from our text messaging program. After opting out, you will no longer receive text messages from us unless you choose to re-subscribe. Opting out of text messages will not affect your ability to use our services or receive communications through other channels such as phone calls or email.

Carrier Liability

Wireless carriers, including but not limited to T-Mobile, AT&T, Verizon, Sprint, and U.S. Cellular, are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless carrier and may be affected by network congestion, coverage limitations, device compatibility, and other factors outside of our control. Neither Maintenance Made Simple nor any wireless carrier shall be liable for any delays, failures, or errors in the delivery of any text messages sent through our SMS program.

Privacy and Data Protection

Your mobile phone number and any information collected through our SMS program will be used solely for the purposes described in these Terms and our Privacy Policy. We will not sell, rent, loan, trade, lease, or otherwise transfer for profit any phone numbers or personal information collected through our text messaging program to any unaffiliated third party for their own marketing purposes. 5. Advertising and Communications

Advertising Cookies and Tracking

6. Payment Terms

Pricing and Payment

Payment for services is due upon completion of the work unless otherwise agreed upon in writing. We accept payment by cash, check, credit card, debit card, and other payment methods as communicated at the time of service. For larger projects, we may require a deposit or progress payments as outlined in a separate service agreement or written estimate.

Late Payments

If payment is not received by the due date, we reserve the right to charge a late fee of 1.5% per month (or the maximum amount permitted by law, whichever is less) on any outstanding balance. You agree to reimburse us for any costs incurred in collecting past-due amounts, including reasonable attorney's fees and collection agency fees.

Disputed Charges

If you believe there is an error in any charge, you must notify us in writing within 30 days of the date of the invoice. We will investigate the dispute and work with you in good faith to resolve the issue. Failure to dispute a charge within 30 days constitutes your acceptance of the charge.

7. Warranties and Limitations

Workmanship Warranty

Maintenance Made Simple warrants that all services will be performed in a professional and workmanlike manner, consistent with generally accepted industry standards. If you are not satisfied with the quality of our work, please contact us within 30 days of the service completion date, and we will make reasonable efforts to correct the issue at no additional charge.

Limitations of Warranty

Our workmanship warranty does not cover defects or damage caused by normal wear and tear, misuse, abuse, neglect, improper maintenance by the customer, modifications or repairs performed by parties other than Maintenance Made Simple, Acts of God (including but not limited to storms, floods, earthquakes, and hurricanes), or pre-existing conditions that were not identified or addressed during our service.

Material Warranties

Any materials, parts, or products installed as part of our services are subject to the manufacturer's warranty, if any. We do not provide any separate warranty on materials beyond the manufacturer's warranty. We will assist you in processing any manufacturer warranty claims for materials we installed.

Limitation of Liability

To the fullest extent permitted by applicable law, Maintenance Made Simple, its owners, officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of use, loss of data, or damage to property, arising out of or in connection with our services, our website, or these Terms, regardless of the theory of liability (whether in contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to our services shall not exceed the total amount paid by you to Maintenance Made Simple for the specific service giving rise to the claim. This limitation of liability applies to the fullest extent permitted by applicable Florida law.

Disclaimer

Our website and all content thereon are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that our website will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

8. Indemnification

You agree to indemnify, defend, and hold harmless Maintenance Made Simple, its owners, officers, directors, employees, agents, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees and court costs) arising out of or related to:

  • Your use of our website or services
  • Your breach of these Terms of Service
  • Your violation of any applicable law, regulation, or third-party right
  • Any inaccurate or incomplete information you provide to us
  • Any property damage or personal injury caused by your negligence or willful misconduct
  • Any dispute between you and a third party relating to our services

This indemnification obligation shall survive the termination of these Terms and the completion of any services.

9. Governing Law

These Terms of Service and any disputes arising out of or relating to these Terms or our services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. You agree that any legal action or proceeding relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you hereby irrevocably consent to the personal jurisdiction of such courts for that purpose.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the provision.

10. Dispute Resolution

Informal Resolution

Before initiating any formal dispute resolution process, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or our services by contacting us directly at info@maintenancemadesimple.net. We will attempt to resolve the dispute informally through good-faith negotiation within 30 days of receiving your written notice of the dispute.

Mediation

If the dispute cannot be resolved through informal negotiation within 30 days, either party may submit the dispute to non-binding mediation before a mutually agreed-upon mediator in Broward County, Florida. The costs of mediation shall be shared equally between the parties, and each party shall bear its own attorney's fees and costs incurred in connection with the mediation.

Litigation

If the dispute cannot be resolved through mediation within 60 days of the initial mediation session (or if the parties cannot agree on a mediator within 30 days of a request for mediation), either party may pursue the dispute through litigation in the state or federal courts located in Broward County, Florida, as described in Section 9 above.

Class Action Waiver

To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Maintenance Made Simple.

11. Termination

Either party may terminate the service relationship at any time by providing written notice to the other party. If you terminate services after work has commenced, you agree to pay for all services performed and materials procured up to the date of termination.

We reserve the right to immediately terminate or suspend our services to you, without notice, if we reasonably believe that you have breached these Terms, engaged in fraudulent or illegal activity, provided false or misleading information, created an unsafe working environment for our employees or contractors, or failed to make timely payment for services rendered.

Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including but not limited to warranty limitations, limitations of liability, indemnification, governing law, and dispute resolution provisions.

12. Additional Terms

Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, photographs, videos, and software, is the property of Maintenance Made Simple or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from our website without our prior written consent.

Third-Party Links

Our website may contain links to third-party websites or services that are not owned or controlled by Maintenance Made Simple. We are not responsible for the content, privacy policies, or practices of any third-party websites. Inclusion of a link on our website does not imply endorsement of the linked site. Force Majeure

Maintenance Made Simple shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to Acts of God, natural disasters (including hurricanes, tropical storms, floods, and tornadoes), pandemics or epidemics, government orders or restrictions, supply chain disruptions, labor shortages, utility failures, or other events beyond our reasonable control.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any written estimates or service agreements provided to you, constitute the entire agreement between you and Maintenance Made Simple with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any provision shall not be deemed a waiver of any other provision, and any waiver shall not be effective unless made in writing and signed by an authorized representative of Maintenance Made Simple.

Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction and without notice to you.
